Minutes of the Regular Council Meeting
April 23, 2007
City Hall Annex Building, 186 Branham Way
Mayor Calhoun called the meeting to order at 6:32pm with the following Council members present: Lloyd Dooley, Greg Gentry, Gary Lawson, Brent Wheeler and Barry Armstrong. Emily Rucker was absent.
Also present were City Treasurer, Peggy Brinkman, Administrative Assistant, Dawn Fick, Utility Superintendent, Ronnie Fick, Chief Rodney Hockenbury and City Attorney Jim Winchell.
Brent Wheeler led the Pledge of Allegiance.
Mayor Calhoun asked those present to take a moment to reflect according to their own beliefs.
Joetta Calhoun stated that Council Member Emily Rucker is still ill and will not be attending the meeting , she ask everyone to remember Mrs. Rucker in prayer.
Minutes
Dawn Fick read the minutes of the April 9, 2007 Regular Council Meeting. Brent Wheeler made a motion to accept the minutes as written, Greg Gentry seconded the motion. Motion carried by a roll call vote.
Peggy Brinkman presented the Treasurers Report for March 2007. Lloyd Dooley made a motion to accept the Treasurer’s Report. Gary Lawson seconded the motion. Motion carried by a roll call vote.
Greg Gentry made a motion for Jim Winchell to read the second reading in summary for the ordinance annexing Brenda Martin property. Brent Wheeler seconded. Motion carried by a roll call vote.
Ordinance
Second Reading
Jim Winchell read a summary Ordinance annexing 0.82 acres more or less known as the Brenda Martin property located at 9089 Hwy 44 East. Ronnie Fick stated that the city is on sewer sanction and this is a new tap, Brenda Martin will need to sign a waiver to send to state for approval. Brent Wheeler made a motion to accept annexation. Shot Dooley seconded. Motion carried.
Scott Sutton stated that he has a private driveway to his house. There are trucks that are preparing to move the houses on the Bypass, formerly known as Wayne Homes that are using this road. Ronnie Fick stated that this said road was not for public dedication. Jim Winchell stated that if Mr. Sutton contends that this road is a private road or easement and if he has an attorney, the city does not have any stand in this matter. This matter should be between Mr. Sutton and Mr. Pruitt. John St. Clair read the surveys regarding Gene Street recorded in the Court House. Discussion followed.
Mayor Report
Mayor Calhoun stated that she contacted Mrs. Geary’s fifth grade class and invited them back to hear the opinion of the council on the proposed smoking ban. Mrs. Geary said they would get back with us at another time due to testing this week.
May 28, 2007 is Memorial Day and it falls on a council meeting night. Brent Wheeler made a motion to cancel this meeting. Shot Dooley seconded the motion. Motion carried by a roll call vote.
Mayor stated that the City Spring Clean was a success and is a good service provided to the community..
Mayor Calhoun and Ronnie Fick met with the Judge Executive and Mayors from other cities. Phase II ordinance was discussed. Ronnie Fick stated that this Ordinance will need to be approved by December 30. 2007. Ronnie Fick also said that there are good things and bad things that could come out of this Ordinance. Barry Armstrong asked Ronnie to present a proposal that lists 5 good things and 5 bad things for the Council to review. Mayor Calhoun stated that we were approved on the E Sanders Lane and Hoagland Hills water project.
Report from Council
Barry Armstrong made a motion to have a resolution or statement recorded, reflecting the city’s sympathy for Virginia Tech Victims. Greg Gentry seconded the motion. Motion carried by a roll call vote.
Gary Lawson asked if the street that had the guard rail in Natures Cove was in the city limits. Ronnie said it was in the city. Ronnie stated that the city was trying something new called speed humps. Joetta ask Jim Winchell if the city will be liable if someone damaged their car as a result of the speed humps. Jim Winchell said he would look into and get back to the council.
Dave Derrick gave an update on the up sizing on the treatment plant.
Executive Session
Barry Armstrong made a motion to enter into executive Session at 7:40pm. Brent Wheeler seconded the motion.
Reconvene
Barry Armstrong made a motion to reconvene at 8:29pm. Greg Gentry seconded the motion. Motion carried.
Jim Winchell stated that there was discussion about a lawsuit that the city is involved in. There was no final action taken as result to executive session.
Adjourn
Brent Wheeler made a motion to adjourn at 8:30. Gary Lawson seconded the motion. Motion carried.
