Minutes of the Regularly Scheduled Council Meeting
April 26, 2004
City Hall Annex Building, 186 Branham Way
Mayor Sullivan called the meeting to order at 6:30pm with the following Council members present: Sam Beichler, Joetta Calhoun, Lloyd Dooley, Sid Griffin, Ralph Lutes and Larry Porter.
Also present were City Clerk Christi Franklin, City Treasurer Peggy Brinkman, Utility Superintendent Ronnie Fick, City Engineer Dave Derrick and City Attorney Rodney Burress.
Ralph Lutes gave the invocation and Sam Beichler led the Pledge of Allegiance.
Minutes
Sid Griffin made a motion to accept the minutes of the April 12, 2004 meeting as corrected. Joetta Calhoun seconded the motion. Motion passed unanimously by a roll call vote. Lloyd Dooley made a motion to accept the minutes of the April 23, 2004 special meeting as written. Sam Beichler seconded the motion. Motion passed unanimously by a roll call vote with Joetta Calhoun abstaining.
Treasurer’s Report
Peggy Brinkman gave the Treasurer’s Report for March 2004. Larry Porter made a motion to accept the Treasurer’s Report for March 2004. Sam Beichler seconded the motion. Motion passed unanimously by a roll call vote.
Ordinances
The Council held second reading of an ordinance to adopt or reject the recommendation of the Bullitt County Joint Planning Commission to rezone 14.32 acres, more or less, located on the west side of Parkland Trace, approximately 600’, more or less, north of Highway 44 East (Docket No. 2004Z-13). Larry Porter made a motion to pass the ordinance adopting the recommendation of the Bullitt County Joint Planning Commission for Docket No. 2004Z-13. Sid Griffin seconded the motion. Motion passed unanimously by a roll call vote.
The Council held second reading of an ordinance annexing 73.83 acres known as the Gladys Cornell Limited Family Partnership property located on the south side of Highway 44 East and the north and east sides of Sanders Lane. Lloyd Dooley made a motion to pass the ordinance annexing the Gladys Cornell Limited Family Partnership property. Larry Porter seconded the motion. Motion passed unanimously by a roll call vote.
The Council held second reading of an ordinance amending the City of Mt. Washington budget for the 2003/2004 fiscal year. Joetta Calhoun made a motion to pass the ordinance amending the City of Mt. Washington budget for the 2003/2004 fiscal year. Ralph Lutes seconded the motion. Motion passed unanimously by a roll call vote.
Joetta Calhoun introduced and the Council held first reading of an ordinance annexing 21.046 acres known as the Board of Education property referenced to the west line of the Ellis Cook Division. No one was in attendance representing the Board of Education to answer questions from the Council. Discussion followed. Larry Porter made a motion to table the second reading of this ordinance until the May 24th meeting to allow the Board of Education to answer questions at the May 10th meeting. Lloyd Dooley seconded the motion. Motion passed unanimously by a roll call vote.
Resolutions
The Council reviewed four resolutions authorizing the sale of property in the Mt. Washington Business Centre for tracts 8, 9, 10 and 15 and authorized the Mayor to direct and execute the contracts, deeds and closing documents. Sid Griffin made a motion to pass all four resolutions. Sam Beichler seconded the motion. Motion passed unanimously by a roll call vote.
Mayor’s Report
Mayor Sullivan reported that the Kentucky Transportation Cabinet scheduled a public information meeting on May 6th at the Pleasant Grove Elementary School from 6:30 – 8:30pm to discuss the improvement of KY 44 from KY 61 in Shepherdsville to US 31E in Mt. Washington. He also reported the City will receive in excess of $21,000 in court costs collected under HB 413 instead of the $12,000 received under the base court revenue program. The City will hold a Spring Clean Up on May 14th from 8:00am to 4:30pm and May 15th from 8:00am to 7:00pm. Mayor Sullivan discussed a request from Bullitt East High School for a donation to project graduation and asked the Council for input. Rodney Burress explained the legality. Discussion followed. Sid Griffin made a motion to reject this donation request. Joetta Calhoun seconded the motion. Motion passed unanimously by a roll call vote. He also received a request from Angie Woodward to start a farmers market on Saturdays, June through October, from 8:00am to 12:00pm. Discussion followed. Sid Griffin made a motion to table the farmers market until the next meeting. Joetta Calhoun seconded the motion. Motion passed unanimously by a roll call vote.
Guests to Address the Council
Norman Lemme thanked the City Clerk for her help and asked that the City update the map of the City limits. He knows there has been a lot of pressure on the Council, and as he sees it, someone approached the City Council for a favor with regard to annexation and he suggested that the City require the property on the west side of the by-pass be cleaned up prior to annexing this person’s other property. Mr. Lemme also said he dropped off flyers to the Council.
Report from Council
Sid Griffin said a pile of dirt and rock is on the street to Green Meadows. Ronnie said the City hasn’t cleaned that up yet because he is ready to do additional work there. He also reported complaints he has received about the junk around Lloyd Kelly’s property. Mayor Sullivan said he will send the City’s Code Enforcement Officer to look at the situation.
Joetta Calhoun asked Rodney Burress if he has heard anything from LG&E regarding their property on Gene Street. Mr. Burress responded no and discussion followed. He will write a letter to LG&E giving them 30 days to remedy the situation. Ms. Calhoun also asked the status of the Grant Lift Station. Dave Derrick said they are on schedule. She discussed nuisances and the legal options. Rodney Burress discussed the options and said he recommended someone make a list of the properties in violation and he would review the list to determine what can be done to bring these properties up the City standards. Ronnie Fick will obtain this list from the City’s Code Enforcement Officer. Ms. Calhoun also discussed the options to remedy the grass cutting situation. Discussion followed. Rodney Burress said each situation should be looked at individually.
Lloyd Dooley discussed a house on Stringer Lane next to Southgate that needs the grass cut. Discussion followed.
Executive Session
Sam Beichler made a motion to enter into executive session at 7:38pm for the purpose of litigation. Sid Griffin seconded the motion. Motion passed unanimously by a roll call vote.
Reconvene
Sid Griffin made a motion to reconvene at 8:12pm. Ralph Lutes seconded the motion. Motion passed unanimously by a roll call vote.
Rodney Burress stated that no action was taken as a result of executive session.
