Minutes of the Special Council Meeting

March 10, 2004

City Hall Annex Building, 186 Branham Way

Larry Porter made a motion to open the meeting at 9:30am.  Lloyd Dooley seconded the motion.  Motion passed unanimously by a roll call vote.  The following were present:  Mayor Frank Sullivan, Council members Sam Beichler, Lloyd Dooley, Sid Griffin, Ralph Lutes and Larry Porter, City Attorney Rodney Burress and City Engineer Dave Derrick.  Joetta Calhoun arrived at 9:35am.

Executive Session

Sam Beichler made a motion to enter into executive session at 9:32am for the purpose of litigation.  Ralph Lutes seconded the motion.  Motion passed unanimously by a roll call vote. 

Reconvene

Lloyd Dooley made a motion to reconvene at 10:30am.  Larry Porter seconded the motion.  Motion passed unanimously by a roll call vote.

Joetta Calhoun made a motion to retain Ronald R. Vanstockum Jr. and Samuel D. Hinkle of the firm of Stoll, Keenon & Park, LLP to represent the City on litigation proposed by Thomas B. Givhan and the Givhan Family Partnership, LTD and matters relating to the upgrade of the wastewater treatment plant.  Sam Beichler seconded the motion.  Motion passed unanimously by a roll call vote.

Adjourn

There being no further business before the Council, Larry Porter made a motion to adjourn the meeting at 10:40am. Sam Beichler seconded the motion.  Motion passed unanimously by a roll call vote.
