Minutes of the Regular Council Meeting

May 14, 2007

City Hall Annex Building, 186 Branham Way

 

Barry Armstrong stated that Mayor Calhoun was called out on an emergency. Shot Dooley made a motion for Barry Armstrong to act as mayor in Mayor Calhoun’s absence. Brent Wheeler Seconded. Motion carried.  

Barry Armstrong called the meeting to order at 6:33pm with the following Council members present:  Lloyd Dooley, Greg Gentry, Gary Lawson, Brent Wheeler Barry Armstrong and Emily Rucker. 

Also present were City Treasurer, Peggy Brinkman, Administrative Assistant, Dawn Fick, Utility Superintendent, Ronnie Fick, Chief Rodney Hockenbury and City Attorney Jim Winchell.   

Emily Rucker led the Pledge of Allegiance.  

Barry Armstrong asked those present to take a moment to reflect according to their beliefs. 

Minutes

Dawn Fick read the minutes of the April 23, 2007 Regular Council Meeting.  Greg Gentry made a motion to approve the minutes as read. Shot Dooley seconded. Motion carried by a roll call vote. 

Chief Rodney Hockenbury presented the Police Report for April 2007. 

Barry Armstrong Welcomed Mrs. Geary’s Fifth Grade Class and opened the floor for their presentation. 

Barry Armstrong introduced Kenneth Stovall as the City Clerk, Recommended by Mayor Clahoun.  Gary Lawson made a motion to appoint Kenneth Stovall as the new City Clerk. Shot Dooley seconded.  Motion carried. 

Peggy Brinkman swore in Kenneth Stovall as the new City Clerk. 

Ordinance

First Reading

a) Brent Wheeler made a motion for Jim Winchell to read a summary of the Ordinance amending the meets and bounds for the property known as Darrell and Sandy Harrod. Greg Gentry Seconded. Motion carried. 

First Reading

b) Jim Winchell held the first reading on the Ordinance amending the 2006/2007 Water & Sewer Budget.

c) Brent Wheeler made a motion for Jim Winchell to read a summary of the Ordinance relating to the sexually oriented business.  Shot Dooley seconded. Motion carried. 

First Reading

d) Greg Gentry made a motion for Jim Winchell to read a summary Ordinance relating to unsafe structures and equipment within the City of Mt. Washington.  Emily Rucker seconded. Motion carried. 

Barry Armstrong stated that the contract for the wrecker service with the Mt. Washington Police Department is very lengthy and would like to have more time to review the contract before making any decisions.    

Sign in Sheet- Audience to address Council

David Proctor stated that there were a few things he would like to see changed on the Wrecker Service Contract.  One being, the rates for the day and night changed to different rates.  Mr. Proctor would also like the mutual aid stay in effect so the wrecker service providers could help each other if needed. Mr. Proctor would like to see the City keep the twenty dollar no key charge stay in the contract.  Mr. Proctor also stated that Bullitt County’s Contract does not allow donations to any organization, such as Operation Bright Christmas, because they are under contract.   

Chief Hockenbury asked David Proctor for his opinion regarding Bullitt County Dispatch handling all the wrecker calls and dispatching. 

David Proctor stated that he believes that he and the other wrecker service providers wanted the calls to be handled through dispatch. Discussion followed. 

Barry Armstrong opened the floor to other wrecker service providers in attendance. 

Tim Hardin of Hardin’s Wrecker Service stated that the County has implemented in their contract that you cannot lease from another wrecker Owner for storage lot.  Mr. Hardin would like to see the council change this in their contract, he has been leasing from another wrecker owner for 10 years and if he can no longer do this, it will put him out of business.  Discussion followed. 

Betty Froelicher thanked Ronnie Fick for getting the street light fixed at Armstrong Lane.  Mrs. Froelicher also stated that she would like to see the water for the city and the rural be the same rate.   

Report from Mayor

Barry Armstrong read the report from the mayor.  He stated that Godsey Associates are the Architects that the council authorized for the design for the New City Hall Building, and the city needs to accept the contract between Godsey and Associates and the City of Mt. Washington.  Brent Wheeler made a motion to accept the contract.  Emily Rucker seconded the motion. Motion carried by a roll call vote. 

Barry Armstrong stated that Mayor Calhoun has recommended a system that will call the Water & Sewer Customers in lieu of the delinquent Notices.  Barry Armstrong stated that the cost of the system will be a one time cost of $2495.00.  Discussion followed.  Brent Wheeler made a motion to purchase the Net Com Auto Calling System. Greg Gentry seconded the motion. Motion carried. 

Barry Armstrong stated that the council received a Proposal for changes to the liquor by the drink Ordinance from Josh Spaulding, owner of Kettle Creek Restaurant.  Barry Armstrong asked Josh Spaulding to speak on what he was proposing to the council. Josh Spaulding stated that the current Ordinance regarding the restaurants that sale liquor by the drink cannot have neon signs or signs advertising beer.  He asked that there be a limit to the signs that a restaurant is allowed to have.  Mr. Spaulding also stated that the ordinance does not allow a cover charge.  He asked that the council would consider changing this part of the Ordinance.  Josh also spoke about possibly changing the Ordinance regarding the Alcohol sales after 12:00am.   Mr. Spaulding also spoke on his opinion regarding no Smoking in Mt. Washington restaurants. Discussion followed. 

Report from Council

Gary Lawson asked about the guard rail on Todd Avenue.  Ronnie Fick said he spoke to Steve with the Transportation Department and should be notified within a month on their decision.  Gary Lawson also asked about Fisher Lane and Armstrong Lane.  Ronnie stated that there are Survey’s being done for a possible Red light at that intersection. 

Ronnie Fick reported that the Spring Festival was a success and the city had a record number of people that attended.

Shot Dooley made a motion to adjourn at 8:29 pm. Emily Rucker seconded the motion. Motion carried.
