Minutes of the Regular Council Meeting

October 8, 2007

City Hall Annex Building, 186 Branham Way

  

Mayor Joetta Calhoun called the meeting to order at 6:30P.M. with the following council members present: Barry Armstrong, Lloyd Dooley, Greg Gentry, Gary Lawson, Emily Rucker and Brent Wheeler.

 Also present were City Treasurer Peggy Brinkman, City Clerk Kenneth Stovall, Police Chief Rodney Hockenbury, City Attorney Anne McAfee, Utilities Superintendent Ronnie Fick and City Engineer David Derrick.

 Barry Armstrong led the Pledge of Allegiance.

 Mayor Calhoun asked those present to take a moment to reflect according to their beliefs.

 Minutes

Kenneth Stovall read the minutes of the September 24, 2007 regular council meeting.  Brent Wheeler noted that the minutes incorrectly reported that he seconded the motion to adjourn into Executive Session.  Barry Armstrong had made the motion; the minutes were corrected.  Barry Armstrong made a motion to approve the minutes as corrected. Lloyd Dooley seconded.  Motion carried by a roll call vote with one abstention.

 Police Report

Police Chief Rodney Hockenbury gave the police report for the month of September 2007.

 Mayor Calhoun said that since the City Attorney was not yet present, she was going off agenda. She said that when the City Attorney arrives we would go back on schedule.

 Sign-In Sheet

Scott Sutton spoke to the council about the maintenance and upkeep of Gene Street as it extends to his house.  Mr. Sutton said that Gene Street ends at his property line and he has paved a fifteen foot wide driveway to his house.  A developer is currently building two houses across the drive from Mr. Sutton’s home and he wants the developer to widen the street to the required twenty foot width and for the City to take over maintenance.  Discussion followed.

 Executive Session

Councilman Barry Armstrong made a motion to adjourn into Executive Session in accordance with KRS 61.810 at 6:53P.M.  Greg Gentry seconded the motion.  Motion carried by a roll call vote.

 At 7:48P.M. Brent Wheeler made a motion to reconvene the regular council meeting.  Emily Rucker seconded the motion.  Motion carried.

 City Attorney Anne McAfee reported that pending litigation and the purchase or sale of real estate were discussed and that no action was taken as a result of the Executive Session.

 Ordinances

Second reading

The Council held a second reading of an ordinance establishing the real and personal property tax rates for the City for the calendar year 2007 and providing assessment equalization and collection.  Barry Armstrong made a motion to pass the ordinance.  Greg Gentry seconded the motion.  Motion carried by a roll call vote.

 

Second reading

The Council held a second reading of an ordinance annexing one acre, more or less, known as the J.B. Proctor and Juanita Proctor property located at 6247 Highway 44E, in the community of Pleasant Grove.  Lloyd Dooley made a motion to pass the ordinance.  Emily Rucker seconded the motion.  Motion carried by a roll call vote.

Mayor Calhoun stated that we are now back on agenda.

 Sign-In Sheet

Mark Holt requested a meeting with the Mayor, Council and City Attorney behind closed doors.  The City Attorney Anne McAfee advised Mr. Holt that council meetings are open and the only closed sessions are those allowed by KRS 68.810. 

 Mayor’s Report

Mayor Calhoun reported on several items:

1) The Mayor said that the Fall Cleanup will be held from October 11 through October 13 from 7A.M. – 7P.M. 

2) The Mayor said that the City is currently operating under a 1979 zoning map.  She said that she has entered into a contract with FMSM to plot out the storm water system and zoning throughout the City and have the information put on a CD.  This will make the information accurate and easy to access.  The project should be completed in late March 2008.

3) The Mayor said that a Storm Water Ordinance as required by the EPA is being prepared and will be presented to the Council when completed.

4) Mayor Calhoun said that about 90% of the road resurfacing for the year has been completed and the remainder should be finished by the end of the week.

5) The Mayor stated that the East Sanders Lane Project is moving quickly. 

6) The Mayor said that we are beginning a project to have American Legal Publishing Corporation put the City’s Code of Ordinances on CD and on the internet.  It will allow easy access to the public and is user friendly.

7) The Mayor said that the parking lot located between the annex building and the water company will be paved by the end of the week.

8) The Mayor also reported that the College Street extension will be completed in three weeks.

  

Report from Council

Councilman Greg Gentry brought up the issue of signs for those businesses that sell alcoholic beverages.  Under the current ordinance, no establishment that sells liquor by the drink may display any sign, banner, poster or other type of display advertising alcoholic beverages.  Businesses that sell package liquor or malt beverages do not have the same restrictions.  Councilman Gentry asked that this issue be studied and that a solution favorable to all affected businesses be reached.  Discussion followed.  Mayor Calhoun appointed a committee to research the issue.  The committee is made up of three Council members; Greg Gentry, Gary Lawson and Brent Wheeler and Alcoholic Beverage Control Officer Melvin Davis.

 Adjourn

There being no further business before the Council, Brent Wheeler made a motion to adjourn at 8:40P.M.  Emily Rucker seconded the motion.  Motion carried.
