Draft Restrictive Covenants

Mt. Washington Business Centre

The purpose of these covenants is to guarantee that all facilities will follow certain minimum standards, keeping the Business Centre a first class development. 

 1.         Exterior walls facing street and 25 ft. side wrap to be of brick, stone, architectural block, concrete or glass. No pole buildings.

 2.         Site plan, building plan, and signage plan require approval by Business Centre Committee. 

 3.         Maximum building coverage is 60% of lot area. 

 4.       Outside storage of materials, product, or non-operating equipment only permitted if screened to avoid viewing from streets by walls                 constructed of material matching building front.  All activities involving the use and/or storage of fuel above or below ground will be subject to Federal, State and County regulations.

 5.         Type uses allowed are those permitted in Light Industrial “IL” Zoning per regulations of Bullitt County Planning Commission.  Excluded uses are:

                         Retail sales

Automotive paint and body shops

Automotive, truck and boat sales

Builders supply stores

Farm implement and contractor equipment sales

Trucking terminals

Livestock killing and dressing

Automotive repair shops

Automotive service stations

Trailer rental and sales

Waste Disposal/porta can rental, retail, or sales

Restaurants - except within allowable businesses

 6.         Minimum building setbacks are 50 ft. from street right-of-way and 25 ft. from side or rear lot line, unless abutting residential property, then 50 ft. lot line.

 7.                  Storage and unloading areas only on side or rear.  Automobile parking in front with architectural or landscaped screening.  Variances on front parking may be considered.  No parking, storage or unloading areas within 50 ft. of street right-of-way or within 25 ft. of side or rear lot line.  No fencing in front of building or within 50 ft. of street right-of-way.  The City allows a 60 ft. curb cut with a 40 ft. maximum width at the property line.  No on street parking through Business Centre will be allowed.   

8.                  All parking, storage, and unloading areas paved with concrete or asphalt before occupancy weather permitting.  All landscaping completed within two months of building completion, weather permitting.  The City of Mt. Washington maintains the right to complete landscaping according to the approved plans, the cost of which will become an assessment against the property if not paid.  

 9.                  No temporary structures, except during construction.

 10.              Utilities to be constructed underground. 

11.              Free standing signs limited to maximum 12 ft. height.

 12.              Minimum lot size is two acres.  No subdividing of lots without approval of Business Centre Committee.  No rezoning without approval of Business Centre Committee.

 13.              Variances allowed from these restrictive covenants, if approved by Business Centre Committee in writing. 

 14.              All development shall be in compliance with regulations of Bullitt County Planning Commission.  Any request for variance shall be approved by the Business Centre Committee.

 15.              If construction is not completed within two years, City has the right to repurchase property at 90% of original sale price. 

 16.              Should property ever be sold to unrelated third party, City shall have the right of first refusal.

 17.              All roads throughout the Business Centre shall have curbs and gutters.

 18.              Exterior wall shall be extended to screen roof top utilities, vents, etc.   

19.              Condition of property.  Owners shall at all times keep grasses trimmed and in good order.  All buildings or improvements shall be maintained in a safe and clean condition.  Outside storage of raw materials shall be located to rear of buildings with proper screening from adjoining residential property and adjoining public streets.  Provisions for trees and shrubs or extensive landscape improvements are encouraged with emphasis on green areas and beautification. 

 20.              Site Improvement.  Owners shall secure all approvals, permits and inspections from the appropriate agency as necessary.  Specific information will be provided by the City. 

 21.              In consideration for maintaining common areas of the Business Centre an annual maintenance fee of $50.00 per acre will be charged.
