Minutes of the Regularly Scheduled Council Meeting
July 8, 2002
City Hall Annex Building, 186 Branham Way
6:30 p.m.
Mayor Ed Hilbert called the meeting to order at 6:30 p.m. with the following
members present: Barry Armstrong, Sam Beichler, Sid Griffin, Ralph Lutes, Frank
Sullivan and Brent Wheeler.
The City Clerk, City Attorney, Utility Superintendent, and City Engineer were
also present.
The invocation was given by Stan Lowery of Pleasant Grove Baptist Church.
Sid Griffin made a motion to accept the minutes of the June 24, 2002 meeting as
read. Sam Beichler seconded the motion. Motion passed. (Unan.)
The second reading was conducted on Ordinance 2002-13 regarding zoning amendment
2002Z-23 for Frank Cornell Development from R-2 residential to R-3 residential
zoning on 4.08 acres at the end of Sunday Silence Drive and West Emerald Circle.
Joe Wantland stated that since the last meeting Mr. Cornell has agreed to
restrictions based on a letter the City received concerning the development that
needs to be considered before voting. Mr. Wantland stated that Mr. Cornell has
agreed to restrictions limiting the development to a 40 unit one story building
complex for senior citizens. Sid Griffin stated that he and Mr. Sullivan visited
the site of the current seniors complex and with the restrictions agreed to by
Mr. Cornell, he felt he could agree with the zoning change because of the need
for such a development in the community and made a motion to adopt Ordinance
2002-13. Sam Beichler seconded the motion. Sam Beichler stated he has made
several trips out to the current seniors complex to count traffic and the
largest number of vehicles in and out of there was 23. If the zoning is denied,
there could be 16 to 17 homes placed on the property which could bring 32-35
vehicles to the property which is more than if the zoning changed. Mr. Beichler
also commented that the complex was first class and how well kept and clean the
property was. Mr. Wantland asked Mr. Cornell, for the record, that the motion
made by Mr. Griffin includes a commitment in the form of written restrictions
with the City for a 40 unit one story building complex for senior citizens and
that no building permits would be issued until that is done. Mr. Cornell
answered yes. Motion passed (Unan.)
The second reading was conducted on Ordinance 2002-14 Zoning Text Amendment
2002T-01 for the City of Shepherdsville amending sections 5.801, paragraph a-39,
paragraph a-40, Section 5.802 , paragraph a-9. Brent Wheeler made a motion to
adopt Ordinance 2002-14. Barry Armstrong seconded the motion. Motion passed. (Unan.)
The first reading was conducted on Ordinance 2002-15 regarding annexation of
Bethel United Methodist Church property of 5.7363 acres on Hwy 44. Sewer is
available by Bethel Branch Subdivision.
There was discussion on an ordinance relating to fences required around swimming
pools. A resident on Meadowview Drive was sited for no fence and submitted
pictures of the pool which is taller than the required fence and latch
requirements. Her pool is 53 inches high and has a locking gate which when in
the locked position is 73 inches from the ground. The ordinance states that
other protective devices approved by the City Council may be used so long as the
degree of protection afforded by the substituted device or structure is not less
than the protection afforded by the enclosure, gate, and latch requirements.
Discussion was tabled to the next meeting to give time for more thought on the
issue before taking action.
Ralph Lutes made a motion to enter into executive session at 7:13 p.m. to
discuss possible litigation. Sid Griffin seconded the motion. Motion passed. (Unan.)
Sid Griffin made a motion to reconvene open session at 8:45 p.m. Frank Sullivan
seconded the motion. Motion passed. (Unan.)
Barry Armstrong made a motion to file suit for declaratory judgement concerning
the development of Nature Cove Subdivision to determine the ownership of the 50
foot section of property between Fernwood Drive and Brian Drive and the property
the guard rail is situated on. Frank Sullivan seconded the motion. Motion
passed. (Unan.)
There being no further business before the Council, Sid Griffin made a motion to
adjourn the meeting. Ralph Lutes seconded the motion. Motion passed. (Unan.)
