Minutes of the Regularly Scheduled Council Meeting

June 13, 2005

City Hall Annex Building, 186 Branham Way

 

Mayor Sullivan called the meeting to order at 6:30pm with the following Council members present:  Lloyd Dooley, Ralph Lutes, Joetta Calhoun, Sid Griffin, Ed Hilbert and Larry Porter. 

 

Also present were City Clerk Christi Franklin, City Treasurer Peggy Brinkman, Utility Superintendent Ronnie Fick, City Attorney Jim Winchell and City Engineer Dave Derrick.

 

Ralph Lutes gave the invocation and led the Pledge of Allegiance.

 

Minutes

Christi Franklin read the minutes of the May 23, 2005 Council meeting.  Sid Griffin made a motion to accept the minutes of the May 23, 2005 meeting as written.  Joetta Calhoun seconded the motion.  Motion passed unanimously by a roll call vote. 

 

Police Report     

Chief Hockenbury presented the police report for May 2005. 

 

Steve Riggs, Vice President of the Helmwood Homeowner’s Association said he has been working with Chief Hockenbury on the Blockwatch program. The Association purchased Blockwatch signs and keeps the neighbors informed.  Mr. Riggs also discussed the other services provided by the Association.  Mayor Sullivan thanked Mr. Riggs for coming and encouraged other subdivisions to use Helmwood’s Homeowners Association as a model.

 

Homeland Security Training

Fire Chief Michael Dooley addressed the ICS training (Incident Command System) and the NIMS Training (National Incident Management System).  He stated that to comply with the requirements for state and federal grants, all employees and elected officials must attend the training and take an online test by August 1, 2005. 

 

Guest to Address the Council

Matt Receveur, 161 Autumn Ridge Drive, addressed the Council about problems with speeding in Autumn Glen.  He would like to see extra police patrols in all of the subdivisions and Highway 44. 

 

Dan Minks, 348 Autumn Glen Drive, said he feels that things were promised by the Developer that are not being done.  He listed those items and said he had legal papers drawn up.  He asked the Council why they keep approving developments for this developer when he is not completing what has been promised to the residents in Autumn Glen.  He doesn’t feel this is fair to the homeowners.  He presented photos and a copy of the deed restrictions to the Council.  Mr. Minks said a Homeowners Association is being formed, but the restrictions are currently enforced by the developer.    Discussion followed.   Mayor Sullivan will have the Code Enforcement Officer look at the issues. 

 

Virgil Farris, 175 Springdale Drive, discussed an easement presented to him several years ago by Bernard Satterly that wasn’t recorded, a bill for sewer repair that he would like paid and asked for the sewer line to be repaired.  Mayor Sullivan addressed these issues and stated that the sewer line is on private property.  Discussion followed.  Jim Winchell reviewed the easement and said that the easement is between the developer and Mr. Farris for the sewer line to service Mr. Farris’ property.  Mr. Winchell discussed the impact of this finding and said he didn’t feel the City would be responsible for maintaining a private sewer line.

 

Jason Riggs, 364 Autumn Glen Drive, said the speeding in Autumn Glen has become a problem and asked the City for speed limit signs.  Ronnie Fick said the signs will be up this week.  Mr. Riggs also discussed high grass, weeds and trash.  Mr. Fick will have the Code Enforcement Officer contact him and set up a time to meet. 

 

Kenny Stout addressed the comments made regarding Autumn Glen.  He said the developer does not have any control over the speed limits or stop signs and trash is due to the construction and not the development.  The developer can only enforce the restrictions.   He agreed that the streets are in need of paving, which has been contracted.  He also addressed pot hole repair. 

 

Ordinances

The Council held second reading of an ordinance relating to grease traps and interceptors.  Sid Griffin made a motion to pass the ordinance relating to grease traps and interceptors.  Larry Porter seconded the motion.  Motion passed unanimously by a roll call vote.

 

The Council held second reading of an ordinance relating to tall grass and weeds being a nuisance.  Joetta Calhoun made a motion to pass the ordinance relating to tall grass being a nuisance.  Sid Griffin seconded the motion.  Motion passed unanimously by a roll call vote.

 

The Council held second reading of an ordinance annexing 359.263 acres, more or less, known as the Frank Cornell, Louise Cornell, Roy Cornell, Shirley Cornell, Clyann Stout and Stout Bros. Farm property located on Stringer Lane.  Discussion followed.  Sid Griffin made a motion to pass the ordinance annexing the Cornell and Stout property located on Stringer Lane.  Lloyd Dooley seconded the motion.  Motion passed unanimously by a roll call vote.

 

Christi Franklin read Mayor Sullivan’s budget message for the 2005/2006 fiscal year.  Discussion followed regarding the proposed site for the new police station.  The Council held a public hearing on the use of the Municipal Road Aid and Local Government Economic Assistance Funds.  No one spoke.  Larry Porter introduced and the Council held first reading of an ordinance adopting the City of Mt. Washington budget for the 2005/2006 fiscal year.

 

Mayor’s Report           

Mayor Sullivan asked Sam Beichler to update the Council about any zoning issues.  Mr. Beichler stated that the Planning & Zoning Commission is continuing to work on re-writing the zoning regulations.

 

Mayor Sullivan reported that the generator at City Hall is now up and running.

 

He also announced that the City signed another contract to sell property in the Mt. Washington Business Centre to Faron McCubbins and should close on that property within the next few weeks.   

 

Report from Council

Joetta Calhoun congratulated the Bullitt East AAU Basketball team.  Discussion followed.  She also asked about the status of the drainage issues discussed at the last Council meeting.  Mayor Sullivan updated the Council.

 

Lloyd Dooley reported that the sidewalk is broken in front of the Flower Pot Florist on Bardstown Road.  He also asked about a water problem on Flatlick Road.  Ronnie Fick said that it is dry now, but will check it again and dig it out to make sure it isn’t a high pressure line.

 

Sid Griffin commented that the City should consider more R-1 zoning and less R-2 and R-3 until the sewers are up to standard.  Jim Winchell addressed the legalities.  Discussion followed.

Sid Griffin made a motion to adjourn at 8:25pm.  Joetta Calhoun seconded the motion.  Motion passed unanimously by a roll call vote.
