Minutes of the Regularly Scheduled Council Meeting
May 13, 2002
City Hall Annex Building, 186 Branham Way
6:30 p.m.



Mayor Ed Hilbert called the meeting to order at 6:30 p.m. with the following members present: Barry Armstrong, Sam Beichler, Sid Griffin, Ralph Lutes, Frank Sullivan and Brent Wheeler.

The City Attorney, City Engineer, and City Clerk were also present.

Brownie troop 1005 led the pledge of Allegiance.

The invocation was given by Mayor Ed Hilbert.

Ralph Lutes made a motion to accept the minutes of the April 22, 2002 meeting as read. Brent Wheeler seconded the motion. Motion passed. (Unan.)

Lisa Robertson, of 297 Winchester Drive, addressed the Council in regard to sewage in her yard from an overflowing manhole on her street. In summary, she stated she has lived there seven years with this problem and wanted to know what is being done about it. She provided pictures to the Council showing sewage on the ground. Dave Derrick explained the infiltration and inflow that doesn=t belong in the system from leaks in the sewer lines and manholes, sump pump and gutter drains connected to the sewer system, and leaks in personal property sewer lines, all contribute, especially in heavy rains, to higher flows into the sewer system that cause overflowing manholes. The City is trying to seek out these extra sources of water going into the system by an on going program to correct these problems. Mr. Derrick stated that the City has received 50% more rain this year which increases the amount of water into our system. This problem does not occur during dry weather unless there is a mechanical or electrical problem with the lift station. Mr. Derrick and the Council stated that Winchester Drive needs to be the priority area. Ms. Robertson asked what the time frame would be to correct the problem. It would be several months for the leak detection program but several years to complete the study and upgrade according to Mr. Derrick. Council member Brent Wheeler stated that he welcomed her to the Council meeting and encouraged her to come to meetings to be heard. This was the first time he and other Council members had heard of this problem. The Council agreed to have the City employees check to see if there are any obstructions in the line, weather permitting, and report back to the Council on this situation.

Cathy Michel, addressed the Council in regard to the zoning amendment for the 100 acres of Autumn Glen Development approved by Planning and Zoning on March 14th. Mr. Miles has since requested the first reading to be withdrawn. In summary, her question to the Council is since it was acted on March 14th by the Zoning Commission and if the City Council does not act on this within 90 days that it is a done deed. The 90 days are about up and she asks that the Council send it back to the Zoning Commission for the following reasons. She is representing her end of town who are residents from Bleemel Lane and Armstrong Lane and submitted a list of 70 names that would like to see the property zoned R1 instead of R2. Another reason is that when letters were sent out by the Zoning Commission, not all adjoining property owners were notified. Also in the comprehensive plan Mr. Miles, of Dogwood Homes, showed existing homes in that area. He identified her guest house of less than 800 square feet rather than her home which is 1,800 square feet. She stated that they have been told and shown plans with entrances on Armstrong and Bleemel and other times 15 driveways onto Bleemel Lane which would be a problem. She stated the plan calls for another 300 homes that she doesn=t feel the Mt. Washington Sewer System can handle until the new equipment and program is completed. Also the drain through the center of Autumn Glen empties on to her property. She doesn=t think her property can handle it. She is asking that the Council could do something before the 90 days is up.

Gale Park, City Clerk, stated that she intended to ask the Council about this issue tonight as to whether the Council wanted to reschedule rather than cancel the meeting on Memorial Day in order to get two readings in before the 90 days is up. There was discussion on the rescheduling. Brent Wheeler made a motion to have the regular Council meeting that would have been held Monday the 27th to Thursday the 30th in leu of Memorial Day Holiday. Barry Armstrong seconded the motion. Earl Barr, who owns rental property at 201 Beechtree Lane, addressed the Council in regard to the old Rodgencamp farm which is now being developed behind him. There is a double road cut through the development that is now putting double the water onto his property and about a 1/4 inch mud over the driveway. Now water & mud has entered the garage. He asked the Council to have someone look at the road and see if something could be done about the mud. Straw could be put down or a burrow to keep the mud and some of the water from coming over. Mayor Hilbert stated he would have someone check it.

Ed Huber, a County resident of Armstrong Lane, addressed the Council about the Autumn Glen Development zoning. He would like to see it zoned R1 and keep the small houses out of the development. He is not against expansion and good houses, but just the small houses. He is also concerned about the roads.

Ed Hilbert announced that the City had met with the Division of Water and discussed the infiltration problem. The Division of Water agrees that we have a good facility, but do have infiltration problems. Dave Derrick, City Engineer, expanded on these comments by adding that the City has talked to the Division of Water at length since receiving the letter about possible sanctions. The City explained the on going problems and program to work on it. The Division of Water has expressed their concerns and have asked the City to provide additional information for further evaluation such as an updated sewer system map and an engineering review of the treatment plant so they can further evaluate the plant and its capabilities. There is currently no sanction on the City of Mt. Washington.

Mayor Ed Hilbert and Council members mentioned thanks to the Lions and Lioness Clubs, Donna Leonhart, Bill Breeden, and City Employees for the successful Spring Festival. Thanks were also given to all who participated in the new City Plaza project and Dedication.

Frank Sullivan made a motion to give $1,500. to the Spring Festival to sponsor the entertainment again at next years Festival. Brent Wheeler seconded the motion. Motion passed. (Unan.)

Gale Park, City Clerk, discussed scheduling a budget review meeting. The meeting was set for Friday the 24th at 2:30 p.m. at the annex building.

Sid Griffin made a motion to enter into executive session at 8:20 p.m. to discuss property. Sam Beichler seconded the motion. Motion passed. (Unan.)

Sid Griffin made a motion to reconvene open session at 9:34 p.m. Brent Wheeler seconded the motion. Motion passed. (Unan.)

There was no action taken as a result of executive session.

There being no further business before the Council, Brent Wheeler made a motion to adjourn the meeting. Ralph Lutes seconded the motion. Motion passed. (Unan.)
