Minutes of the Regularly Scheduled Council Meeting

May 23, 2005

City Hall Annex Building, 186 Branham Way

 

Mayor Sullivan called the meeting to order at 6:30pm with the following Council members present:  Lloyd Dooley, Ralph Lutes, Joetta Calhoun, Sid Griffin, Ed Hilbert and Larry Porter. 

 

Also present were City Clerk Christi Franklin, City Treasurer Peggy Brinkman, Utility Superintendent Ronnie Fick, City Attorney Jim Winchell and City Engineer Dave Derrick.

 

Larry Porter gave the invocation and led the Pledge of Allegiance.

 

Mayor Sullivan presented a plaque to Rodney Burress and thanked him for his service as City Attorney.

 

Minutes

Christi Franklin read the minutes of the May 9, 2005 Council meeting.  Discussion followed.  Sid Griffin made a motion to accept the minutes of the May 9, 2005 meeting as written.  Lloyd Dooley seconded the motion.  Motion passed unanimously by a roll call vote.  Ms. Franklin also read the minutes of the May 11, 2005 special Council meeting.  Joetta Calhoun made a motion to accept the minutes of the May 11, 2005 special Council meeting as written.  Ralph Lutes seconded the motion.  Motion passed unanimously by a roll call vote.

 

Treasurer’s Report

Peggy Brinkman gave the Treasurer’s Report for April 2005.  Larry Porter made a motion to accept the Treasurer’s Report for April 2005.  Ralph Lutes seconded the motion.  Motion passed unanimously by a roll call vote.

 

Ordinances

The Council held second reading of an ordinance to adopt or reject the recommendation of the Bullitt County Joint Planning and Zoning Commission to re-zone 7.46 acres, more or less, known as the Stout Brothers Farms, Inc. property located on the east side of S. Bardstown Road, directly across from Old Bardstown Road from Agricultural to R-1 Residential (Docket No. 2005Z – 18).  Sid Griffin made a motion to accept the recommendation of the Bullitt County Joint Planning Commission and re-zone 7.46 acres, more or less, known as the Stout Brothers Farms, Inc. property from Agricultural to R-1 Residential (Docket No. 2005Z-18).  Lloyd Dooley seconded the motion.  Motion passed unanimously by a roll call vote.

 

The Council held second reading of an ordinance to adopt or reject the recommendation of the Bullitt County Joint Planning and Zoning Commission to re-zone 8 acres, more or less, known as the John Lentz and Judy Lentz property located at 261 Gentry Lane from Agricultural to R-2 Residential (Docket No. 2005Z – 19).  Discussion followed.  Larry Porter made a motion to accept the recommendation of the Bullitt County Joint Planning Commission to re-zone 8 acres, more or less, known as the John Lentz and Judy Lentz property from Agricultural to R-2 (Docket No. 2005Z-19).  Joetta Calhoun seconded the motion.  Motion passed by a vote of 5 to 1 as follows:

The Council held second reading of an ordinance annexing 1.50 acres, known as the Greg and Diania McIntyre property located at 13025 Highway 44E.  Joetta Calhoun made a motion to pass the ordinance annexing the McIntyre property located at 13025 Highway 44E.  Ed Hilbert seconded the motion.  Motion passed unanimously by a roll call vote.

 

Sid Griffin introduced and the Council held first reading of an ordinance relating to grease traps and interceptors.  Ronnie Fick discussed the reasons why the ordinance is needed and answered questions from the Council.  Discussion followed.

 

Sid Griffin introduced and the Council held first reading of an ordinance relating to tall grass and weeds being a nuisance. 

 

Lloyd Dooley introduced and the Council held first reading of an ordinance annexing 359.263 acres, more or less, known as the Frank Cornell, Louise Cornell, Roy Cornell, Shirley Cornell, Clyann Stout and Stout Bros Farm property located on Stringer Lane.  Frank Cornell discussed the proposed use of the property and answered questions from the Council.

 

Guest to Address the Council

James Price, 183 Valley Drive discussed a drainage issue.  Mayor Sullivan will address this issue.

 

Mr. S.R. Cook, 185 Beechtree Lane, discussed a drainage issue and submitted photos to the Council showing the drainage problems during the recent heavy rain.  Discussion followed.  Mayor Sullivan stated the City would shoot the grade and dig the ditch if the property owners would put in tiles.

 

Mayor’s Report           

Mayor Sullivan reported that the City closed on the fourth lot in the business park this fiscal year.  Discussion followed. 

 

Regarding the house behind the fire station, Mayor Sullivan said it has been moved to the by-pass.

 

Mayor Sullivan also reported that the signs have been stripped from the telephone poles. 

 

Report from Council

Sid Griffin addressed complaints from business owners that the public is using their dumpsters.  He asked if the City can run a notice in the paper reminding the public that this cannot be done.  Discussion followed.  The police department will work with the business owners on this issue.

 

Joetta Calhoun commended Chief Hockenbury and the police department for their 50% case solvability rate.

 

 

Executive Session

Sid Griffin made a motion to enter into executive session at 7:45pm for the purpose of pending litigation.  Ralph Lutes seconded the motion.  Motion passed unanimously by a roll call vote.

 

Reconvene

Sid Griffin made a motion to reconvene at 8:28pm.  Larry Porter seconded the motion.  Motion passed unanimously by a roll call vote.

 

Jim Winchell stated that no action was taken as a result of executive session.

 

Adjourn

Sid Griffin made a motion to adjourn at 8:29pm.  Ralph Lutes seconded the motion.  Motion passed unanimously by a roll call vote.
