Minutes of the Regularly Scheduled Council Meeting

May 9, 2005

City Hall Annex Building, 186 Branham Way

 

Mayor Sullivan called the meeting to order at 6:30pm with the following Council members present:  Lloyd Dooley, Ralph Lutes, Joetta Calhoun, Sid Griffin, Ed Hilbert and Larry Porter. 

 

Also present were City Clerk Christi Franklin, City Treasurer Peggy Brinkman, City Attorney Jim Winchell and City Engineer Dave Derrick.

 

Mayor Sullivan introduced and welcomed Jim Winchell as the new City Attorney.

 

Ralph Lutes gave the invocation and led the Pledge of Allegiance. 

 

Minutes

Christi Franklin read the minutes of the April 25, 2005 Council meeting.  Sid Griffin made a motion to accept the minutes of the April 25, 2005 meeting as written.  Joetta Calhoun seconded the motion.  Motion passed unanimously by a roll call vote.  Ms. Franklin also read the minutes of the May 4, 2005 special Council meeting.  Ralph Lutes made a motion to accept the minutes of the May 4, 2005 special Council meeting as written.  Ed Hilbert seconded the motion.  Motion passed unanimously by a roll call vote.

 

Police Report

Chief Hockenbury presented the April 2005 Police Report.

 

Ordinances

The Council held second reading of an ordinance amending the City of Mt. Washington budget for the 2004/2005 fiscal year.  Discussion followed.  Larry Porter made a motion to pass the ordinance amending the City of Mt. Washington annual budget for the 2004/2005 fiscal year.  Sid Griffin seconded the motion.  Joetta Calhoun stated that she voted no because she doesn’t believe in this method of operating.  She thinks the change should come to the Council before the money is committed when a budget amendment is needed and will vote this way in the future.  Discussion followed.  Motion passed by a vote of 4 to 2 with the abstention going with the majority:

Lloyd Dooley introduced and the Council held first reading of an ordinance to adopt or reject the recommendation of the Bullitt County Joint Planning and Zoning Commission to re-zone 7.46 acres, more or less, known as the Stout Brothers Farms, Inc. property located on the east side of S. Bardstown Road, directly across from Old Bardstown Road from Agricultural to R-1 Residential (Docket No. 2005Z – 18).  Mark Stout discussed the reason for the requested change and answered questions from the Council. 

 

Larry Porter introduced and the Council held first reading of an ordinance to adopt or reject the recommendation of the Bullitt County Joint Planning and Zoning Commission to re-zone 8 acres, more or less, known as the John Lentz and Judy Lentz property located at 261 Gentry Lane from Agricultural to R-2 Residential (Docket No. 2005Z – 19).  Richard Miles representing Dogwood Homes discussed the reason for the change and answered questions from the Council. 

 

Sid Griffin introduced and the Council held first reading of an ordinance annexing 1.50 acres, known as the Greg and Diania McIntyre property located at 13025 Highway 44E.  Greg McIntyre answered questions from the Council.

 

Capital Budget Amendment

Christi Franklin discussed the requested Police Department capital budget amendment for the 2004/2005 fiscal year.  Ed Hilbert made a motion to pass the Police Department capital budget amendment.  Joetta Calhoun seconded the motion.  Motion passed unanimously by a roll call vote. 

 

Report from Council

Larry Porter reminded the Council and public about the Spring Festival this weekend. 

 

Ed Hilbert said he received a complaint of a road blocked in Woodlake by Greenbriar and will discuss this with the developer.  He also discussed a complaint about the house to be moved behind the Fire Department.  Discussion followed.  Mayor Sullivan said he will address this with the Code Enforcement Officer.

 

Joetta Calhoun thanked Rodney Burress for his service to the City and said he will be missed.  She asked for a proclamation for his service.  Mayor Sullivan said Mr. Burress was unable to attend this meeting and he will invite him to the next meeting.  Ms. Calhoun also asked the progress of the list of items to be completed for the treatment plant upgrade.  Dave Derrick said the City is working on the infiltration and the 201 Study at this time.  He will give Ms. Calhoun a copy of the agreed order listing the items to be completed.

 

Dave Derrick reported that the 201 Facility Plan Study Committee met and discussed the planning area.  He also said that he, Mayor Sullivan and Ronnie Fick met with Shepherdsville and the Bullitt County Sanitation District regarding their planning areas.  Discussion followed. 

 

Jim Winchell reported that the current nuisance ordinance does not contain a provision for high grass, only weeds.  He said the ordinance can be amended.  Discussion followed.  Mayor Sullivan will look further at the ordinance, and if this provision is not in the ordinance, an amendment will be drafted.

Sid Griffin made a motion to adjourn at 7:16pm.  Joetta Calhoun seconded the motion.  Motion passed unanimously by a roll call vote.
